Terms of Sale, Product, and Pricing Information

1. GENERAL PROVISIONS

1.1. These e-store sales and usage terms (hereinafter referred to as the "Terms") apply to all individuals purchasing products or receiving services through the e-store operated by Bitwise Foundation OÜ, registration code 14246348, located at Liivalaia 28, 10118 Tallinn, Harju County.

1.2. It is mandatory for you to review and accept these Terms.

1.3. In regulating their mutual relations, the contracting parties shall adhere to the Law of Obligations Act and other laws and regulations of the Republic of Estonia, as well as the agreements set forth in these Terms of the Bitwise Foundation OÜ e-store.

1.4. Bitwise Foundation OÜ reserves the right to modify or supplement the e-store’s sales terms and price list. Any changes or additions will be announced through the e-store website and take effect upon publication. If an order is placed before the changes take effect, the terms valid at the time of the order will apply unless otherwise required by law or these Terms.


2. PRICES

2.1. All prices in the e-store are in euros (€) and include VAT.

2.2. Bitwise Foundation OÜ reserves the right to change the prices displayed in the e-store at any time. If the prices change after an order has been placed, the products will be delivered at the prices valid at the time of the order. Customers are not entitled to claim compensation for price differences.


3. MAKING A PURCHASE AND PLACING AN ORDER

3.1. Products offered in the e-store are available for purchase by both private individuals and legal entities.

3.2. To place an order, the desired products must be added to the shopping cart. The required fields must be filled in, and a suitable delivery method must be selected. The total payment amount will then be displayed, which can be paid securely via various payment methods (see section 4.2).

3.3. To confirm the order, click the "Update Cart" button and proceed to checkout by selecting "Continue."

3.4. The order is considered completed once the order confirmation and payment receipt have been confirmed.

3.5. If the seller is unable to fulfill the order (e.g., the product is out of stock), the seller will contact the customer to offer an alternative or refund the payment within 14 days of notification.


4. PAYMENT FOR PRODUCTS

4.1. Select a suitable payment method during checkout.

4.2. Customers can pay for orders using the following payment methods:

  • Bank transfer
  • Visa/Mastercard card payments (via Stripe)
  • Estonian bank payments (Swedbank, SEB, LHV, Coop Bank, Luminor, Revolut, etc.)
  • Pay in cash on the spot

4.3. Note: When paying via bank link, ensure you click the "Return to Merchant" button on the bank’s page.

Payments are processed by Maksekeskus AS. Payment transactions take place outside the e-store in a secure environment—bank link payments are processed in the respective bank’s secure environment, and credit card payments in Maksekeskus AS’s secure environment. The seller does not have access to the customer’s banking or credit card details. The contract takes effect once the payment has been received in the e-store's bank account.

The e-store owner is the responsible processor of personal data and will forward the necessary personal data for payment processing to the authorized processor, Maksekeskus AS.

If the ordered product cannot be delivered due to being out of stock or other reasons, the customer will be notified as soon as possible, and the paid amount (including delivery costs) will be refunded immediately, but no later than 14 days from the notification.

4.4. The order will be canceled if the payment is not received within 5 days.


5. DELIVERY AND HANDOVER OF PRODUCTS

5.1. Products can be received at various locations based on the selected delivery method.

5.2. In Estonia, orders can be received via:

  • Smartpost parcel machines, Omniva parcel machines, Smartpost courier
  • Cargobus, DHL, or other courier services
  • In-person pickup in Tallinn or Tartu

Delivery costs are paid by the store.

Domestic deliveries within Estonia usually arrive within 3 business days after the contract has taken effect. Deliveries outside Estonia will be completed within 14 calendar days.

5.3. The specific delivery method and timeframe will be agreed upon when arranging the shipment.

5.4. The estimated delivery time can be checked on the product page.


6. RIGHT OF RETURN

6.1. Customers have the right to withdraw from the e-store contract within 14 days of receiving the order.

The right of withdrawal does not apply if the buyer is a legal entity.

To exercise the 14-day return right, the product must not be used beyond what is necessary to determine its nature, characteristics, and functioning in a way permitted for testing in a physical store.

If the product has been used beyond this purpose or shows signs of use or wear, the e-store has the right to reduce the refundable amount accordingly.

To return an item, the buyer must submit a withdrawal request using the following form: [Insert link to withdrawal form]

Return costs are covered by the buyer unless the reason for the return is due to a defect or incorrect product.

The buyer must return the product within 14 days of submitting the withdrawal request or provide proof that the product has been handed over to a courier within this timeframe.

Upon receiving the returned product, the e-store will refund all payments made by the buyer within 14 days from the withdrawal request.

The e-store may withhold the refund until the returned product has been received or proof of return has been provided, whichever occurs first.

If the buyer has explicitly chosen a more expensive delivery method than the standard one, the e-store is not obliged to refund the extra cost.

The e-store reserves the right to withdraw from the sales transaction and request the return of the product if the product price was significantly lower than the market price due to an error.


7. RIGHT TO FILE A CLAIM

The e-store is responsible for any non-conformities or defects present at the time of delivery and that become apparent within two years of product delivery.

The buyer must submit a claim within two months of discovering a defect by emailing info@nordicgamer.ee or calling +372 58 929 575.

The e-store is not responsible for defects that arise after the product has been handed over to the buyer.

If the product is found to be defective, the e-store will repair or replace it. If repair or replacement is not possible, the e-store will refund all related costs.

The e-store will respond to complaints within 15 days.


8. DIRECT MARKETING AND DATA PROCESSING

The e-store processes customer data only for order fulfillment and product delivery. Personal data is shared with delivery service providers as necessary.

The e-store sends newsletters and offers only with the customer's explicit consent. Customers can unsubscribe at any time.


9. CUSTOMER OBLIGATIONS

The customer must:

  • Use the device according to its intended purpose.
  • Prevent misuse, physical damage, and exposure to harmful external conditions.
  • Bring faulty products to the agreed service location during the warranty period.

10. LIABILITY AND FORCE MAJEURE

10.1. Bitwise Foundation OÜ is not liable for damages caused by force majeure events.


11. DISPUTE RESOLUTION

If disputes arise, customers may contact info@nordicgamer.ee or call +372 58 929 575.

If an agreement cannot be reached, the customer may turn to the Consumer Disputes Committee or the EU Online Dispute Resolution platform.
